TERMS & CONDITIONS

Watsons Snap Your Best Moment with Ribena Contest is organized by Suntory Beverage & Food Malaysia Sdn. Bhd (“The Organiser”).

1. Customers constitutes the full and unconditional agreement to and acceptance of these Terms and Conditions (including any variations to the same made by BRAND’S Suntory (M) Sdn. Bhd. without any requirement of notice).
2. The contest is open to all citizens residing in Malaysia that purchase Ribena Jelly products at Watsons Malaysia through physical and online store.
3. The contest begins 00.00am on 1st Feb 2023 and ends at 11.59PM on 30th Apr 2023 (“Contest Period”).
4. All entries must be received by our system by 23:59:59 (Malaysian Time), 30th Apr 2023 to qualify.
   Late and invalid entries will not be entertained. The time is based on our server’s system time.
5. The Organiser reserves the right to reject and/or remove any entries that are incorrect, incomplete, suspicious, invalid or do not meet our Contest Terms & Conditions. Customer agree not to knowingly damage or cause interruption to the Contest and/or prevent others from entering The Contest.
6. The Organiser reserves the right to reject and/or remove any entries that are deemed inappropriate and/or offensive to others. Customers agree not to submit entries that promotes or portray nudity, sexually explicit material, coarse or offensive language, or other material susceptible of offending others.
7. The Organiser reserves the right in its sole discretion, without prior notice, and without any liability to any person, at any time to change the Terms and Conditions including to change the Contest Period, make Prize substitutions, cancel, terminate, or suspend the Contest in whole or in part. In the event of any changes to the Terms and Conditions, Participants agree that their continued participation in the Contest will constitute their acceptance of the Terms and Conditions (as revised).
8. The Organiser retains the right to substitute any prize with another prize of similar value in the event that the original prize offered is not available.
9. The Organiser and its respective parent companies, affiliates, subsidiaries, licensees, directors, officers, agents, independent contractors, advertising, promotion, fulfilment agencies, and legal advisors are not responsible for and shall not be liable for:
   9.1 Any technical errors, whether due to inaccessibility of internet, network disruption, network congestion, malicious virus attacks, unauthorized data hacking, data corruption and server hardware failure or otherwise;
   9.2 Telephone, electronic, hardware or software programme, network, internet, server or computer malfunctions, failures, interruptions, miscommunications or difficulties of any kind, whether human, mechanical or electrical, including without limitation, the incorrect or inaccurate capture of entry information online;
   9.3 Late, lost, delayed, misdirected, incomplete, illegible or unintelligible uploads;
   9.4 Failed, incomplete, lost, garbled, jumbled, interrupted, unavailable or delayed computer transmissions;
   9.5 Any condition caused by events beyond the control of The Organiser that may cause The Contest to be disrupted or corrupted;
   9.6 Any injuries, losses, or damages of any kind arising in connection with or as a result of attending the event, the gift, or acceptance, possession, or use of the Prize, or from participation in the Contest;
   9.7 Any printing or typographical errors in any materials associated with The Contest .
   By participating in contest, each customer agrees to release from all liabilities and hold harmless The Organiser and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, promotion, fulfilment agencies, and legal advisors from any and all losses, damages, rights, claims and actions of any kind in connection with contest or resulting from acceptance, possession, use or misuse of the e-reload pin, or travel to or from any gift-related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
10. The Organiser and its respective parent companies, subsidiaries, affiliates, licensees, directors, officers, employees, agents, independent contractors and advertising/promotion agencies make no warranties, express or implied, in fact or in law, relative to the use or enjoyment of the Prize, including without limitation, their quality, merchantability or fitness for a particular purpose.
11. By entering, customers agree to grant The Organiser and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies the use of his/her name, video, photo, details submitted through The Contest, likeness, biographical data and statements for any purposes, including, without limitation, advertising, marketing, communication, trade, or promotion, in perpetuity and throughout the universe, in any and all media now known or hereafter devised, without notification or further compensation, unless prohibited by law.
12. Appeals to check the status of contest will not be entertained.
13. All of the Organiser’s decisions in connection with this contest shall be final, conclusive and binding and the customers agree to abide by The Organiser’s decision with respect to all aspects in connection with The Contest. By participating in The Contest, the participants agree not to challenge and/or object to any decisions made by The Organiser in connection with The Contest.
14. The Organiser reserves the right to revise the mechanics of this Contest, the terms and conditions, and other aspects of this contest at its discretion without prior notice.
15. The Organiser reserves the right to suspend, cancel or extend the duration (“Extended Period”) of this contest at its discretion due to unforeseen circumstances without prior notice. Unless an Extended Period is announced, any entries received after the end of the Contest Period (due to any reason howsoever and/or whatsoever arising) shall be disqualified. Any customer in the contest during the Extended Period (if any) shall be governed by these terms and conditions (“Terms and Conditions”) which shall remain in full force and effect.
16. The Organiser and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies shall not be liable to the customers or any other party for any loss or damage of whatsoever nature suffered by any participant as a result of participation or non-participation in the contest or as a result of any act or omission on the part of The Organiser and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies.

HOW TO PARTICIPATE

1. Purchase 2 packs of Ribena Jelly at Watsons Malaysia in-store or online store to participate the contest during the Contest Period.
2. Keep your receipt as proof of purchase and present it to The Organiser via Ribena Contest official no 017-7470037 include with your details as below:
   
   i. Full name
   ii. IC Number
   iii. Address
   iv. H/P number
   v. Photo of Watsons receipts (Keep the original Proof of Purchase for verification purposes throughout the contest period)
3. All prizes will be processed to transfer to the winners within six (6) to eight (8) weeks from the end of the Contest Period.
4. The Organiser reserves the right to reject any entries failing to meet the requirement above.

PRIZES

1. There are a total of 50 pair of GSC ticket for grabs during the contest period.
2. Winners will be contacted via phone number or e-mail & will be announced on the official Facebook (“Ribena Malaysia”) once the selection is done.
3. A total of 50 Winners will be selected at the end of the Contest Period.
4. The Organiser reserves the right to provide a substitute prize of similar value should the need arise without prior notice. The payment of all costs and expenses involved in claiming the prize are the responsibility of the winner(s).

The Organiser will not be responsible for any loss, mishap, injury, damage, claim or

accidents arising from the participation of The Contest and/or collection of the prizes.

1. If winners do not revert with their details within the stipulated duration, prize will be forfeited, and The Organiser reserves the right to select an alternative winner.
2. Prizes are not exchangeable, transferable or redeemable in any other form for whatever reason. The Winners are solely responsible for the collection of their prize(s).
3. All the Winners must abide by terms and conditions of the parties arranging and/or providing for the prizes and the terms and conditions attached to the prizes, if any.
4. In the event the Winner chooses not to accept the prize, they will disclaim all rights, interests and claims to that prize and the prize will be dealt with according to the sole and absolute discretion of The Organiser.
5. All prizes are accepted entirely at the risk of the Winners, and The Organiser excludes all liabilities, representation and warranties in connection with any prize to the extent permitted by law. The Winners shall comply with the terms and conditions of each prize.
6. All brands, names and trademarks associated with or used to describe the prizes are owned by their respective owners. The Organiser are not related to, connected to or associated with these parties in any way.
7. Unless otherwise stated, The Organiser retains all proprietary rights to the intellectual property used for The Contest and owns the copyright to all contents within.

How to claim your prize:

1. The 50 winners will be selected based on the photo creativity in the presence of the Ribena team at the end of contest period.
2. At the time that a potential prize winner is identified, the potential prize winner will be contacted by a representative from the Organizer at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents to the organizer representative.
3. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the organizer representative. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited, and the organizer will pick another lucky winner deemed the potential prize winner subject to the terms and conditions.
4. If the organizer representative are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers or delayed responses to Facebook Private Messages, such winner will be disqualified and the organizer pick another luck winner will be deemed the potential prize winner subject to the terms and conditions herein.
5. Eligible winners will collect the prizes at the Brand’s Suntory Company based on the date that the organizer will be set up.

Privacy Notice

By submitting the Contest, you hereby consent to the Organiser’s collection, use and disclosure of your personal data for (a) any and all purposes as set out in our Privacy Policy

1. recording of each customers personal data for entry in this Contest;
2. verification of such personal data;
3. communication with each customer for purposes related to this Consent;
4. disclosing your personal data to our appointed agency and other authorised third parties, if any, for purposes of operating, reporting or promoting this Contest;
5. such further or consequential use of personal data as and when necessary in the operation of this contest; and
   unless you withhold consent, the use of your name, likeness, image and/or voice in the event that you win the prize (including photograph, film and/or other recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Contest (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Organiser.
