Campaign Terms and Conditions
Entire Terms
These terms and conditions constitute the entire agreement of the parties relating to the entry into and conduct of this Campaign organized by Crayon Rigel Resources (the “Organizer”) on behalf of Omron. Information on how to enter the Campaign forms part of these terms and conditions.
Acceptance of Terms and Conditions of Entry
Entry into the Campaign is deemed acceptance of these terms and conditions.
Governing Law
These terms and conditions are governed by the laws of Malaysia.
Eligible Participants
This campaign is open to all consumers of Omron at participating retail outlets (Refer to Participating outlets) in Malaysia, excluding:
(a) management, employees, directors and contractors of Omron and The Organizer;
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in clause 4(a)of these terms and conditions; or
(c) persons who have breached the terms and conditions of any competition or Campaign run by or on behalf of Omron.
The persons referred to in this clause 4 of these terms and conditions include natural and non-natural relations (in the opinion of The Organizer) and the decision of The Organizer in determining the eligibility of any person shall be final and binding.
Participants to Ensure Familiarity
Each Participant is responsible for ensuring familiarity with these terms and conditions at the time of participation in this Campaign. The Organizer’s decision not to enforce a specific restriction (whether communicated to a Participant or not) does not constitute a waiver of that restriction or of the terms and conditions generally.
Participants Acknowledgment
All Participants acknowledge that The Organizer can rely on these terms and conditions even if The Organizer only learns of a person’s ineligibility after The Organizer has awarded a Prize to an ineligible person. Return of a Prize or payment of its equivalent value to The Organizer may be required by The Organizer if this occurs.
Campaign Period
7.1 This Campaign starts on 1 May 2022, 12.00am and ends on 25 June 2022, 11.59 pm.
7.2 An Entry must only be made during the Entry Period and submit receipt and receiving details through the Omron Campaign WhatsApp number +6011 7292 7925.
Campaign Mechanics
8.1 The participants who purchase an Omron Blood Pressure Monitors worth RM150 and above from 1 May 2021 – 25 June 2021 will receive a Borosilicate Glass Container, purchase RM200 and above will receive two(2) unit of Borosilicate Glass Container during the campaign period with the submission of a valid receipt based on first- come-first-serve basis, and stand a chance to answer & win an OMRON Bamboo Thermos Flask 450ml with Free Engrave special message for loved one ( limited to xxx words ).
8.2 The Prizes for this campaign are:

NB : Prize/Prizes are not transferrable or exchange with cash.
8.3 Multiple entries are NOT allowed. Each Eligible Participant should submit his/her entry only once.
Invalid Entries
9.1 Repeated or duplicated receipt submitted using different contact number is not allowed. For multiple entries with same receipt filling up with multiple contact number, The Organizer will take the first entry’s submission only as it is first-come-first-serve basis.
9.2 Multiple entries with different receipts using same contact number is not allowed to avoid fraud claim.
9.3 Incomplete, illegible, indecipherable, incorrect, or corrupted entries, or which contain offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are invalid and not eligible to win a Prize.
9.4 Any Entry not complying with these terms and conditions is invalid.
9.5 The Organizer assumes no responsibility for any failure to receive any Entry or for any inaccurate informationor for any loss, damage, or injury as a result of technical or telecommunications problems with entry mechanisms or otherwise, including security breaches. If such problems arise, then The Organizer has the right to modify, cancel, terminate or suspend the Campaign.
Verification
10.1 The Organizer reserves the right to request at its discretion, within a time prescribed by The Organizer, verification of age, identity, eligibility, compliance with these terms and conditions, residential address of Participants and/or any other information relevant to entry into, participation or claiming a Prize in the Campaign.
10.2 If the information requested is not received by The Organizer or a Participant has not been verified to the satisfaction of The Organizer within the time prescribed by The Organizer, any Entry submitted by the Eligible Participant will be deemed as invalid. A Prize will only be awarded following all validation and verification requirements of The Organizer being met to its satisfaction and at its discretion. In the event that an Eligible Participant cannot provide suitable validation or verification, the Eligible Participant’s right to a Prize will be forfeited and no substitute will be offered.
Winner Notification and Publication
11.1 The Borosilicate Glass Container 1040ml under this Campaign will be delivered to the eligible participants within 14 (Fourteen) working days from the submission of the valid receipt and complete recipients’ details.
11.2 The OMRON Thermos Flask 450ml with free Engraving under this Campaign will be delivered to the eligible participants within 21(Twenty-one) working days after the announcement of the lucky winners. The announcement of the Thermos Flask weekly lucky winners will make thru Omron Facebook page.
11.3 If the Participant does not receive the prize, it is the Participant’s responsibility to alert The Organizer through WhatsApp number +6011 7292 7925 latest by 16 July 2022. Any alert from the Participant received by The Organizer after the said period will not be entertained. The Organizer will not be held liable in any manner whatsoever for non-receipt of the prizes by the Consumer.
The Organizer’s Rights
12.1 The Organizer’s decision in relation to the Campaign and any aspect of these terms and conditions is final and binding.
12.2 Upon submission of a relevant Entry, the Submission submitted by the Participant shall become the property of The Organizer and all intellectual property vested in such Submission shall be deemed to be assigned/passed to The Organizer.
12.3 The Organizer reserves the right to publish the name of the Participant on its Facebook page, other social media platform or anywhere else.
12.4 The Organizer reserves the right to amend any details of the Campaign without prior notice or any notice .
Tampering and Other Failures
13.1 If, for any reason, the Campaign is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorized intervention, fraud or any other cause beyond the control of The Organizer, which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Campaign, The Organizer reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the Campaign.
13.2 Any Participant who, in the opinion of The Organizer, tampers or interferes with the entry or selection mechanism in any way, engages in any unlawful or improper conduct which jeopardizes or is likely to jeopardize the fair or proper conduct of the Campaign, or who does not properly comply with the entry process, will be ineligible to win a Prize.
13.3 Any attempt to deliberately damage any information on a website, or to otherwise undermine the legitimate operation of this Campaign may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, The Organizer reserves the right to seek damages to the maximum extent permitted by law and/or to initiate appropriate legal action against such person.
Exclusion of Liability
14.1 The Organizer and all agencies associated with the Campaign and all employees, agents, directors and contractors, of all such entities shall not be liable for any loss or claim, action, demand, liability, damage,cost, expense, personal injury or death whatsoever (including but not limited to any direct, indirect and / or consequential loss or loss of profits), incurred, suffered or sustained (whether or not arising from any person’s negligence) by any person or entity (without limitation) in connection with, or arising from, the Campaign or the acceptance or use of any Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
14.2 The Organizer accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, corrupted or misdirected Entries due to error, omission, tampering, deletion, theft, communications failure or otherwise.
14.3 The Organizer is not responsible for:
(a) any problems or technical failures of any kind, including malfunction of any telephone networkor lines, computer online systems or networks, servers or providers, computer equipment, or software;
(b) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the internet or at any website;
(c) any electronic or human error (without limitation);
(d) any unauthorized human intervention; or any consequences thereof, in association with this Campaign.
14.4 To the maximum extent permitted by law, any liability of The Organizer or its servants or agents for breach of any rights a consumer might have which cannot be excluded under applicable consumer protection laws, is limited to the payment of the cost of having a Prize supplied again.
Tax Liability
The Organizer accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a Prize. Independent financial advice should sought by each Participant for any tax implications arising from Prize winnings.
Publicity
16.1 The Prize Winners consent to the use of their name, suburb or town of residence, text and image of any Entry for promotional or marketing purposes (including publicity online and social media) and agree to participate in any reasonable promotional activity (such as publicity and photography) relatingto the winning of a Prize, free of charge, at the request of The Organizer.
16.2 Participants agree that The Organizer has an unrestricted, irrevocable, transferable, divisible right and license to use and modify any Entry for the purposes of The Organizer’s business (including publicity online and social media) without the payment of further fee or compensation. Each Participant agrees to sign any further documentation required by The Organizer to give effect to this arrangement as a precondition of being awarded any Prize.
16.3 To the extent permitted by law, Participants unconditionally and irrevocably consent to any act or omission that would otherwise interfere with any moral rights in any Entry.
Ownership of Entries
All Entries become and remain the sole property of The Organizer.
Personal Information
18.1 All information provided by Participants (Personal Information) will be used by The Organizer for the purpose of conducting this Campaign and may be entered into a database and may be used by The Organizer, agencies engaged by The Organizer, or any other third party(s) nominated by The Organizer, for The Organizer’s current and future promotional and marketing purposes without further reference or compensation to them.
18.2 The Organizer may disclose Participants’ Personal Information to its contractors and agents to assist in conducting this Campaign and as required, to regulatory authorities.
Headings
The headings in these terms and conditions are for convenience only and do not affect interpretation of these terms and conditions.
Severability
If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect other provisions of these terms and conditions, which shall remain in full force and effect. Where relevant, the parties shall use their reasonable endeavors to find a new stipulation resembling the invalid one in its commercial consequence as much as possible.
Waiver
Failure or suspension by any Party to enforce any right resulting from breach of any term in these terms and conditions shall not be deemed a waiver of any right relating to subsequent breach of such term or of any other right hereunder. Any waiver must be in writing and signed by the party granting such waiver.
